Introduction to the rental terms

The following rental terms apply to all rentals of agricultural machinery and attachments by the Bischofberger family. They are intended to establish clear rules for the use of the machines and to avoid misunderstandings between the lessor and the renter. A transparent regulation of use, liability and return of the machines protects both the business and the renter from unexpected costs or damage.

By renting a machine, the renter agrees to the stated terms. The rental terms define in particular the permitted use of the machines, the responsibilities during the rental period, as well as the requirements for insurance, maintenance and return of the equipment. This ensures that the machines are operated safely and remain in proper condition for further use.

The following rental terms apply to all rentals of our agricultural machinery. They serve to ensure the safety of people, animals and machines, as well as a smooth rental process.

Rental conditions for agricultural machinery

Please read the rental terms carefully. Machines may only be operated by trained personnel. If you have any questions, we are happy to assist.

1. Scope of application

  • Applies to all agricultural machinery rentals by the Bischofberger family
  • Matters not regulated are subject to the Swiss Code of Obligations (CO)

2. Rental period

  • 1 day: maximum 9 hours
  • Longer rental periods possible by agreement
  • The rental period begins handover at the farm in Schönengrund and ends upon return at the same location

3. Driving licence & authorisation

The renter must hold a valid driving licence for the respective machine or vehicle category. The rented machines may only be operated by authorised, trained and experienced persons .

The renter is responsible for ensuring that all persons operating the machine have the required knowledge, authorisation and experience. The lessor reserves the right to check the driving licence and verify identity before the start of the rental.

 

Aebi Vario VT450 transporter (green licence plate):

  • Driving authorisation for agricultural vehicles required
  • Use on public roads only with a valid licence and for agricultural purposes
  • Compliance with applicable traffic regulations and the Road Traffic Act (SVG) when used on public roads
  • Speed limits and traffic rules must be observed at all times
  • Experience in the safe handling of the vehicle is required
  • Liability for damage on public roads lies with the driver or renter

 

Avant 750 front loader (white licence plate):

  • A valid driving licence for the relevant vehicle category is required
  • Operation only by experienced and suitable persons

 

4. Handover & return

  • Machines are handed over cleaned, in working condition and with standard accessories übergeben
  • The renter checks the machine upon handover and reports any damage immediately
  • The machine must be returned in the condition in which it was handed over, complete and in working condition
  • In case of heavy soiling , a cleaning fee may be charged
  • Late return: at least ½ day rental fee will be charged additionally

5. Use of the machines

The machines may only be used:
  • in accordance with their intended use
  • from authorised and experienced persons
The following are not permitted in particular:
  • Subletting to third parties
  • Use outside the agreed areas of operation
  • Technical modifications to the machine

Our machines are regularly maintained and inspected to ensure safe operation. Nevertheless, the renter is obliged to check the machine for visible damage or malfunctions before starting work and to report any issues immediately.

The machines may only be used for agricultural or intended work. Improper use or overloading can lead to damage and must be avoided. Careful handling of the machines contributes significantly to safety and to the long-term usability of the equipment.

Fuel & consumables

The renter is responsible for:

  • Fuel
  • Consumables
  • Wear parts during use

The machines must be returned with the same fuel level as at handover. Consumables, wear parts and fuel will be charged according to use

 

6. Liability & damage

The renter is liable for all damageoccurring during the rental period, in particular due to:

  • Improper operation
  • Overloading of the machine
  • Negligent use
  • Use by unauthorised persons

The lessor is not liable for:

  • Accidents
  • Injuries
  • Direct or indirect consequential damage

 arising from the use of the machine

Technical failures caused by improper use are to be borne by the renter

Missing machines or tools will be charged at replacement verrechnet

7. Insurance

The renter is responsible for ensuring that their liability insurance covers damage arising from the use of rented machines or third-party attachments.

When using our attachments on the renter’s own machines, the renter is responsible for ensuring that their liability insurance covers damage to third-party attachments or rented equipment. Damage to third-party attachments used on one’s own machines is often not automatically covered by insurance and may require additional coverage.

8. Breakdowns and repairs

In case of technical issues, we must be informed immediately..

Repairs may only be carried out after prior consultation. durchgeführt werden.

If a machine becomes inoperative due to improper use , the renter is responsible for:

  • Repair costs
  • Possible loss of rental income

10. Safety when using agricultural machinery

Safe operation is particularly important when using agricultural machinery. Further information on accident prevention and the safe handling of agricultural machinery can be found at the Beratungsstelle für Unfallverhütung in der Landwirtschaft (BUL).

11. Jurisdiction

  • Swiss law applies
  • Place of jurisdiction: registered office of the rental provider, Canton of St. Gallen
